  Judge orders security guard posted outside violence-plagued liquor store - MLive.com

  FLINT, MI – A judge ordered the owners of embattled liquor store to hire a security guard to watch over the parking lot if it wants to remain open.

  Genesee Circuit Judge Joseph J. Farah said on Wednesday, Sept. 7 that Liquor Plus Mini Mart,  407 Martin Luther King Ave., can continue to remain open at night as long as there is a security guard in the parking lot from 8 p.m. until midnight.

  Genesee County Prosecutor David Leyton was granted a temporary restraining in a civil lawsuit filed against the business and its owner but the business was allowed to reopen Monday, Aug. 29.

  Judge allows padlocked liquor store to reopen

  Attorney Roger G. Isaac argued on behalf of Sukhjinder Chahal on Wednesday, Sept. 7, that the liquor store should not be closed for up to a year under the state's public nuisance law.

  "We opened the store for 24 hours because of the arson – we wanted to protect the $400,000 investment," Isaac said, adding that his clients cannot be responsible for loiters outside of the store. "It's a parking lot open to the public. What do you want us to do, put a gate up? The prosecutor has put an unfair burden on us to control things they can't control."

  Chahal is allowed to operate the store after her husband Lakhbir "Lucky" Chahal was arrested on suspicion of food stamp and wire fraud.

  Court documents detail two years' worth of police complaints and alleged criminal activity at the liquor store in court documents that led to the temporary restraining order and padlock under the state's public nuisance law.

  Farah heard opening arguments and testimony from three witnesses in the civil trial on Wednesday.

  William Hammond has lived near the store since 1961 and said he is the former director of Salem Housing Community Development Corporation.

  The non-profit owns a rental house across the street from Liquor Plus and Hammond said the group hasn't been able to rent it out since 2010 because of the violence that occurs outside of the store.

  "I would say that it is not a desirable store. Not a desirable business. People don't feel safe there," Hammond testified.

  There were five shootings outside the store since July 26, including the slaying of 27-year-old Corandis Jenkins. A teenager was subsequently shot near the store during a vigil for Jenkins, a 10-year-old who was shot inside a vehicle in June and a triple shooting Aug. 7.

  Liquor Plus Mini Mart has been the site of criminal activity going back to 2014, Genesee County Circuit Court records show, despite the store being closed for reconstruction for eight months.

  Calls to police included reports of gun violence, assault, drug-dealing, shots fired, loitering and the alleged illegal sale of alcohol, court records show.

  The trial will continue on Friday, Sept. 9.
